1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR REFERRAL WILL NOT INCREASE YOUR CHANCES OF WINNING. REFERRAL BONUS ENTRIES INCREASE TOTAL ENTRIES BUT DO NOT GUARANTEE WINNING.
2. SPONSOR
The ARK Design + Build Custom Bed Swing Giveaway (“Giveaway”) is sponsored by ARK Design + Build, a Mississippi sole proprietorship, located at 316 Old Jackson Road, Madison, Mississippi 39110 (“Sponsor”). The Giveaway is administered solely by Sponsor. By participating in the Giveaway, each entrant agrees to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Giveaway.
3. ELIGIBILITY
The Giveaway is open to legal residents of the United States who reside within the following Mississippi communities or their immediate surrounding areas: Madison, Gluckstadt, Ridgeland, Fondren, Brandon, and Flowood (collectively, the “Eligible Service Area”). Entrants must be at least eighteen (18) years of age at the time of entry.
The following persons are not eligible to participate:
- Employees, officers, directors, and agents of ARK Design + Build, and their immediate family members (spouse, parents, siblings, children, and their respective spouses) and household members (whether or not related);
- Any person involved in the development, production, execution, or distribution of this Giveaway;
- Any person who does not reside at a physical residential address within the Eligible Service Area where professional installation of the Prize can be reasonably performed.
Proof of residency within the Eligible Service Area may be required for Prize fulfillment. Sponsor reserves the right to verify eligibility at any time. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law.
4. GIVEAWAY PERIOD
The Giveaway begins at 10:00 AM Central Standard Time (“CST”) on Friday, February 27, 2026, and ends at 11:59 PM CST on Tuesday, March 31, 2026 (the “Giveaway Period”). Entries received before or after the Giveaway Period will not be eligible. Sponsor’s computer is the official timekeeping device for the Giveaway.
5. HOW TO ENTER
Method 1: Online Entry (Primary)
During the Giveaway Period, visit https://arkdesignbuild.com/events/ and complete the official entry form in its entirety. Required fields include: first name, last name, email address, phone number, zip code, and response to outdoor project interest question. Submission of the completed form constitutes one (1) entry into the Giveaway (“Personal Entry”). All entries must be received by the end of the Giveaway Period.
Method 2: Alternate Means of Entry (AMOE) — No Internet Required
To enter without internet access, hand-print your full legal name, complete mailing address, email address (if available), phone number, and date of birth on a 3″ x 5″ card or plain piece of paper and mail it to:

Mail-in entries must be postmarked no later than March 27, 2026, and received by March 30, 2026. Each mail-in entry received in compliance with these Official Rules will receive one (1) Personal Entry into the Giveaway. Mailed entries that are illegible, incomplete, damaged, destroyed, forged, or otherwise not in compliance with these Official Rules will be disqualified.
Method 3: Referral Bonus Entries
After completing a Personal Entry (via Method 1 or Method 2), entrants may earn additional bonus entries (“Referral Bonus Entries”) by referring other individuals to enter the Giveaway.
How Referral Bonus Entries Work:
a) Unique Referral Link. Upon completing a Personal Entry online (Method 1), each entrant will receive a unique referral link that they may share with friends, family, and acquaintances.
b) Earning Bonus Entries. When a new, unique individual clicks an entrant’s referral link and completes their own valid Personal Entry (i.e., submits a completed entry form for the first time), the referring entrant will automatically receive one (1) Referral Bonus Entry. Each Referral Bonus Entry counts as one (1) additional entry in the drawing.
c) Maximum Referral Bonus Entries. Each entrant may earn a maximum of ten (10) Referral Bonus Entries during the Giveaway Period, for a total maximum of eleven (11) entries per person (one Personal Entry plus up to ten Referral Bonus Entries).
d) Referred Person Requirements. The referred individual must be a real, unique person who independently completes a valid Personal Entry in full compliance with these Official Rules. The referred individual must not have previously entered the Giveaway. Each referred individual may only be credited to one (1) referring entrant.
e) Referral Bonus Entry for Mail-In Entrants. Entrants who submitted a Personal Entry by mail (Method 2) may request Referral Bonus Entries by mailing a separate 3″ x 5″ card or plain piece of paper to the address listed in Method 2, clearly marked “REFERRAL BONUS ENTRY REQUEST,” including the referring entrant’s full legal name and the full legal name and email address of each referred individual. The referred individual must have independently completed their own valid Personal Entry. Mail-in Referral Bonus Entry requests must be postmarked no later than March 27, 2026, and received by March 30, 2026. The same maximum of ten (10) Referral Bonus Entries per entrant applies.
f) Verification. Sponsor reserves the right to verify that each referred individual is a real, unique person who has independently completed a valid Personal Entry. Referral Bonus Entries attributed to referred individuals who are fictitious, duplicate, ineligible, or who did not independently complete a valid Personal Entry will be void.
Entry Limitations
- Limit one (1) Personal Entry per person, regardless of method of entry. A person may submit only one Personal Entry, whether online (Method 1) or by mail (Method 2). Submitting more than one Personal Entry by any method or combination of methods will result in disqualification of all entries (including any Referral Bonus Entries) by that person.
- Each entrant may earn a maximum of ten (10) Referral Bonus Entries in addition to their one (1) Personal Entry, for a combined maximum of eleven (11) total entries per person.
- Referral Bonus Entries are tied to the referring entrant’s Personal Entry. If a Personal Entry is disqualified for any reason, all associated Referral Bonus Entries are also void.
- Entries generated by script, macro, bot, or other automated means are void. This includes, without limitation, the use of automated systems to generate referral clicks, fake accounts to simulate referred entries, or any other method designed to artificially inflate Referral Bonus Entries.
- Self-referral (referring oneself using a different name, email address, or identity) is strictly prohibited and will result in disqualification of all entries by that person.
- Referral schemes involving coordinated or reciprocal referral arrangements for the primary purpose of accumulating Referral Bonus Entries (rather than genuine recommendations) may be deemed fraudulent at Sponsor’s sole discretion and may result in disqualification.
- All entries become the property of Sponsor and will not be acknowledged or returned.
- Proof of submission does not constitute proof of receipt by Sponsor.
6. DRAWING AND WINNER SELECTION
One (1) potential winner will be selected in a random drawing on or about April 2, 2026, from among all eligible entries received during the Giveaway Period. Each entry — whether a Personal Entry or a Referral Bonus Entry — counts as one (1) equal entry in the drawing pool. An entrant who has earned Referral Bonus Entries will have multiple entries in the drawing pool and therefore a proportionally greater chance of being selected; however, earning Referral Bonus Entries does not guarantee winning.
The drawing will be conducted by the Sponsor or its designee. The odds of winning depend on the total number of eligible entries (including Referral Bonus Entries) received.
The potential winner will be notified by email at the email address provided at the time of entry within three (3) business days of the drawing date. If a potential winner cannot be reached, does not respond to the notification within five (5) calendar days of the first notification attempt, or declines the Prize, that potential winner will be disqualified and an alternate winner may be selected from the remaining eligible entries in a subsequent random drawing.
Sponsor reserves the right to conduct up to three (3) alternate drawings to award the Prize. If, after three (3) alternate drawings, a qualified winner has not been identified, Sponsor reserves the right to not award the Prize.
7. PRIZE
Prize Description
One (1) grand prize will be awarded, consisting of:
A handcrafted, custom-built bed swing designed and constructed by ARK Design + Build, including:
- One (1) custom-built wooden bed swing, handcrafted by ARK Design + Build
- One (1) outdoor mattress sized to fit the bed swing
- Outdoor pillows sized to complement the bed swing
- Professional installation at the winner’s residential property by ARK Design + Build
Approximate Retail Value (“ARV”):Â Six Thousand Dollars ($6,000.00 USD).
Prize Conditions and Limitations
- The Prize is awarded “as is” with no warranty or guarantee of any kind, express or implied.
- The specific design, dimensions, materials, color, and finish of the bed swing will be determined by Sponsor in its sole discretion and may vary from any bed swing displayed at promotional events, in photographs, or in marketing materials.
- Professional installation is included in the Prize and will be performed by ARK Design + Build at the winner’s residential property. Installation is limited to residential properties within the Eligible Service Area (Madison, Gluckstadt, Ridgeland, Fondren, Brandon, and Flowood, Mississippi).
- Installation requires a structurally suitable location as determined by ARK Design + Build in its sole professional judgment. Suitable locations generally include covered porches, pergolas, and other overhead structures capable of supporting the weight and motion of an occupied bed swing. If the winner’s property does not have a structurally suitable installation location, Sponsor will work in good faith with the winner to identify a reasonable alternative. If no suitable location can be identified or agreed upon, Sponsor may, at its sole discretion: (a) provide reasonable modifications to accommodate installation, or (b) award the bed swing, mattress, and pillows without installation, in which case the winner assumes all responsibility for installation.
- Winner must provide reasonable access to their property for installation at a mutually agreed-upon date and time. Installation is subject to weather conditions, permit requirements (if any), and scheduling availability. Installation will be completed within ninety (90) calendar days of winner verification, unless otherwise agreed in writing.
- The winner is responsible for any homeowners association (HOA) approvals, permits, or other authorizations required for installation at their property. Sponsor assumes no liability for any HOA violations, fines, or disputes arising from installation.
- Prize is non-transferable, non-exchangeable, and may not be redeemed for cash, credit, or any other form of consideration. No substitution of the Prize is permitted except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if the Prize (or any component thereof) becomes unavailable for any reason.
- Only the Prize specified in these Official Rules will be awarded. Any depiction of the Prize in promotional materials is for illustrative purposes only and may not reflect the exact Prize awarded.
8. WINNER VERIFICATION
The potential winner may be required to:
- Provide valid government-issued photo identification to verify identity and age;
- Provide proof of residency within the Eligible Service Area (e.g., utility bill, driver’s license, or lease/mortgage statement);
- Execute an Affidavit of Eligibility and Liability Release;
- Execute a Publicity Release (except where prohibited by law);
- Complete and return IRS Form W-9 or equivalent tax documentation.
All requested documentation must be completed, signed, and returned within ten (10) calendar days of receipt, or the potential winner will be disqualified and an alternate winner may be selected. Non-compliance within the specified time period, return of Prize notification as undeliverable, or any other failure to comply with these Official Rules will result in disqualification.
9. TAX RESPONSIBILITY
The winner is solely responsible for all federal, state, and local taxes, including but not limited to income tax, arising from acceptance and use of the Prize. The Prize has an ARV of $6,000.00. Because the Prize value exceeds $600.00, Sponsor will issue an IRS Form 1099-MISC (or applicable form) to the winner for the value of the Prize as required by law. The winner may be required to provide a valid Social Security Number or Taxpayer Identification Number for tax reporting purposes. Failure to provide required tax information will result in forfeiture of the Prize.
10. GENERAL CONDITIONS AND LIMITATIONS OF LIABILITY
By entering the Giveaway, each entrant agrees to:
a) Release and Indemnification. Release, discharge, indemnify, and hold harmless Sponsor, and each of its officers, employees, agents, representatives, contractors, successors, and assigns (collectively, the “Released Parties”) from and against any and all claims, damages, losses, costs, expenses, or liability (including, without limitation, property damage, personal injury, or death) arising out of or relating to: (i) participation in the Giveaway; (ii) acceptance, possession, use, misuse, or installation of the Prize; (iii) any typographical or other error in the printing, offering, or announcement of the Prize or winner; (iv) technical failures of any kind, including but not limited to malfunctions of computer hardware or software, telephone lines, network connections, or electronic or internet connectivity during any aspect of the Giveaway; or (v) any other cause beyond the reasonable control of Sponsor.
b) Publicity Release. Except where prohibited by law, acceptance of the Prize constitutes the winner’s consent for Sponsor to use the winner’s name, likeness, photograph, voice, statements, biographical information, and city and state of residence for advertising, promotional, and publicity purposes in any and all media now known or hereafter developed, worldwide, in perpetuity, without additional compensation, notice, review, or approval.
c) Compliance. Abide by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects.
d) Disclaimer of Warranties. THE PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SPONSOR MAKES NO WARRANTY OR REPRESENTATION REGARDING THE QUALITY, SAFETY, OR SUITABILITY OF THE PRIZE.
e) Limitation of Liability. IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE TO ANY ENTRANT FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE GIVEAWAY OR THE PRIZE, REGARDLESS OF THE FORM OF ACTION OR THEORY OF LIABILITY. THE TOTAL LIABILITY OF THE RELEASED PARTIES SHALL NOT EXCEED THE ARV OF THE PRIZE ($6,000.00).
11. DATA COLLECTION AND PRIVACY
Information Collected
By entering the Giveaway, entrants consent to the collection and use of the following personal information: first name, last name, email address, phone number, zip code, and outdoor project interest response. Referral activity data (referral links shared, referral completions) may also be collected for Giveaway administration purposes.
Use of Information
Personal information collected through the Giveaway will be used by Sponsor for the following purposes:
- Administration of the Giveaway, including winner selection, notification, and referral tracking;
- Verification of winner eligibility;
- Prize fulfillment, including scheduling and performing installation;
- Marketing communications from ARK Design + Build, including but not limited to email newsletters, promotional offers, and service-related information.
Marketing Communications Consent
By submitting an entry, entrants consent to receive periodic marketing communications from ARK Design + Build via email. Entrants may unsubscribe from marketing communications at any time by clicking the “unsubscribe” link in any email or by contacting Sponsor directly. Unsubscribing from marketing emails will not affect an entrant’s eligibility to win the Giveaway or invalidate any earned Referral Bonus Entries.
Data Sharing
Sponsor will not sell, rent, or share entrants’ personal information with third parties for their independent marketing purposes. Personal information may be shared with third-party service providers solely to the extent necessary to administer the Giveaway (e.g., email delivery services, website hosting providers, referral tracking platforms). Tax reporting information will be shared with government authorities as required by law.
Data Retention
Entry data will be retained for a period of one (1) year following the conclusion of the Giveaway, after which it will be securely deleted or anonymized, except as required for tax reporting, legal compliance, or ongoing marketing communications for entrants who have not unsubscribed.
Compliance
Sponsor’s collection and use of personal information is subject to all applicable federal and state privacy laws, including the CAN-SPAM Act for commercial email communications.
12. DISPUTES AND GOVERNING LAW
Except where prohibited, by participating in the Giveaway, each entrant agrees that:
a) Governing Law. These Official Rules and any disputes arising out of or relating to the Giveaway shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of laws provisions.
b) Jurisdiction and Venue. Any legal proceedings arising out of or relating to the Giveaway shall be brought exclusively in the state or federal courts located in Madison County, Mississippi, and each entrant consents to the exclusive jurisdiction and venue of such courts.
c) Limitation on Claims. To the fullest extent permitted by law, any claim or cause of action arising out of or relating to the Giveaway or these Official Rules must be filed within one (1) year after the cause of action accrues. Failure to file within this period shall constitute a waiver of such claim.
d) Waiver of Class Action. To the fullest extent permitted by applicable law, all claims must be resolved on an individual basis. Entrants agree not to participate in any class, consolidated, or representative action against Sponsor.
13. DISQUALIFICATION
Sponsor reserves the right, in its sole discretion, to disqualify any entrant who:
- Tampers with the entry process, the referral system, the operation of the Giveaway, or any Sponsor website;
- Violates these Official Rules;
- Attempts to undermine the legitimate operation of the Giveaway by cheating, deception, fraud, or other unfair means;
- Acts in a disruptive, annoying, threatening, harassing, or abusive manner toward Sponsor, its representatives, or other entrants;
- Submits more than one (1) Personal Entry in violation of the one-Personal-Entry-per-person limit;
- Creates fake accounts, fictitious identities, or uses any deceptive method to generate or inflate Referral Bonus Entries;
- Engages in self-referral (entering the Giveaway under multiple identities) or coordinates reciprocal referral schemes;
- Provides false, fraudulent, or misleading information on the entry form or in connection with any referral activity;
- Does not reside within the Eligible Service Area at the time of entry or at the time of Prize fulfillment.
Disqualification of an entrant results in the voiding of their Personal Entry and all associated Referral Bonus Entries. Any attempt to deliberately damage or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent of the law.
14. FORCE MAJEURE
If, for any reason, the Giveaway is not capable of running as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, severe weather, natural disaster, pandemic, government regulation, or any other cause beyond Sponsor’s reasonable control that corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Giveaway, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Giveaway (including the referral bonus entry program) and select the winner from among all eligible entries received prior to the action taken.
15. SEVERABILITY
If any provision of these Official Rules is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of these Official Rules.
16. ENTIRE AGREEMENT
These Official Rules constitute the entire agreement between each entrant and Sponsor with respect to the Giveaway and supersede all prior or contemporaneous communications, whether electronic, oral, or written, with respect to the Giveaway.

These Official Rules are effective as of February 27, 2026. Sponsor reserves the right to modify these Official Rules at any time prior to the start of the Giveaway Period. Any modifications made during the Giveaway Period will be communicated to entrants via the Giveaway entry page.
